He resigned in 2006, the year he received the Ramon Magsaysay Award for his work with the Parivartan campaign, and launched the Aam Aadmi Party in November 2012.

Chief Minister

He first became Chief Minister of Delhi in December 2013 and resigned after 49 days. The AAP won a sweeping majority in 2015 and he returned, serving a third term after the 2020 election.

The excise policy case

On 21 March 2024 the Enforcement Directorate arrested him over alleged irregularities in Delhi's liquor policy, making him the first sitting Chief Minister in India to be arrested. The Supreme Court granted him bail on 13 September 2024, and he resigned four days later. Atishi succeeded him. In the February 2025 election the AAP lost power and he lost New Delhi to the BJP's Parvesh Verma.

On 27 February 2026 a Rouse Avenue court discharged him and 22 others in the CBI's case, saying the material did not show even a prima facie case. The CBI said it would appeal. The ED's money laundering case remains, and he has said he will seek discharge there too. His 2025 affidavit lists 15 pending cases and no convictions, and assets of about Rs 4.2 crore.
